Welcome to Streamifly. These Terms and Conditions govern your use of the Streamifly platform and services. By accessing or using Streamifly, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our services.
1. Account Registration and Security
When you create an account with us, you must provide accurate, complete, and current information at all times. You are responsible for safeguarding the password that you use to access Streamifly and for any activities or actions under your password.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
2. User Content
Our platform allows you to upload, share, and store content such as videos, texts, graphics, and audio. You retain ownership of your content, but by uploading or sharing it, you grant Streamifly a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, distribute, and display such content for the purpose of providing and promoting our services.
You represent and warrant that:
- You own or have the necessary rights to use and authorize Streamifly to use your content.
- Your content does not violate the privacy, publicity, copyright, or other intellectual property rights of any person or entity.
- Your content does not contain any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
3. Prohibited Content and Activities
You may not use Streamifly for any illegal or unauthorized purpose. You agree not to, and will not allow any third party to:
- Upload or share content that promotes illegal activities, discrimination, or harm against any individual or group.
- Upload or share content that infringes upon intellectual property rights, including copyright and trademark.
- Upload or share pornographic, violent, or otherwise offensive content.
- Attempt to gain unauthorized access to any portion of the Streamifly platform or its systems.
- Use Streamifly to transmit any viruses, malware, or other malicious code.
- Engage in any activity that disrupts or interferes with the Streamifly platform.
4. Copyright Policy
We respect the intellectual property rights of others and expect our users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law.
If you believe that your content has been copied in a way that constitutes copyright infringement, please provide us with the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed.
- Your contact information, including your address, telephone number, and email address.
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
5. Termination
We may terminate or suspend your account and access to the Streamifly platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use Streamifly will immediately cease. If you wish to terminate your account, you may simply discontinue using our services or contact us to request account deletion.
6. Disclaimers
The Streamifly platform is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, timely, secure, or error-free.
We do not warrant that the results that may be obtained from the use of Streamifly will be accurate or reliable. You are solely responsible for any damage to your computer system or loss of data that results from your use of our platform.
7. Limitation of Liability
To the maximum extent permitted by law, in no event shall Streamifly, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Streamifly platform.
- Any conduct or content of any third party on the Streamifly platform.
- Any content obtained from the Streamifly platform.
- Unauthorized access, use, or alteration of your transmissions or content.
8. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Streamifly.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the India, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
